Working with Uninsured Individuals in Injury Cases

Statistically, one in every eight drivers does not have insurance coverage. If you should find yourself in the unfortunate situation where someone has hurt you who did not have insurance at the time, there are still options for you. In most insurance plans, there is a policy for the uninsured. This policy means if a person who’s injured you doesn’t have any insurance coverage, you may still seek reimbursement through your private insurance. Please note, this may slightly affect your monthly insurance payments, but not to the extent that you should defer from pursuing the un-insured claim. You would do best to consult your attorney about your options to determine the best action plan for you. What happens though, if there isn’t an un-insured policy in your insurance plan? You still may have options. You may be able to file a personal injury claim against the person directly instead of going after their insurer. You will need to show proof that the other person’s negligence was the direct and absolute cause of your injuries.

Handling your Injury Case

If you are faced with a situation as explained above, make sure that you immediately call the police after the accident, they will need to gather facts and determine who the at-fault driver was. Please make sure that you do not accept any monetary offers from the other driver. They may try to pay you for your damages. Still, there is no way to determine the extent of damage to your car, or injuries from the accident, without a full detailed workup of the vehicle by professionals. Additionally, you may experience symptoms resulting from the accident that were not present at the time of the accident, and come on later after the adrenaline wears off. Also, even though they may not have an insurance card, it is important to obtain their information still. Make sure to ask for their identification and phone number so that the police and your insurance company can contact them to discuss settlement options for you. Ensure you also gather the vehicle’s details, such as the make and model of the vehicle, license plate, and VIN. I’m sure you’ve heard the saying, “a picture says one thousand words,” that is very true in this particular situation as well. In current-day society, we are encouraged to take videos and photographs of our surroundings and situations we are involved with. Now, it seems more and more that it didn’t happen if it wasn’t recorded. Not only is it is very important for your case to take pictures of everything, but it is also your right to record video and take photographs. Especially when trying to file a personal injury claim against the person directly, they may try to argue the facts differently from how you remember them or how they actually happened. Having substantial evidence will help protect the facts of your case rather than having it thrown out as a “he said, she said” disagreement.
